Archetype Privacy Policy

This Privacy Policy (the "Privacy Policy" or "Policy") describes the types of information that Archetype Inc. and its affiliates ("Archetype", "we", "our" or "us") collect and process from and relating to you.

Except as described below, this Policy applies to all websites, mobile applications, and any other electronic/digital products or other services made available by Archetype and linked to this Policy and our offline services (collectively, the "Services").

Capitalized terms not defined in this Policy have the meanings set forth in the Archetype Terms of Service.

1. Information We Collect

When you access or otherwise use our Services, we collect information from you. The types of information we collect depend on how you use our Services. Please note that we need certain types of information to provide you with the Services. If you do not provide us with such information, or if you ask us to delete it, you may no longer be able to access or use certain Services. The information we collect includes data you provide directly to us, data we obtain automatically from your interactions with our Services, and data we obtain from other sources.

Information You Provide Directly

We collect information directly from you. For example, you provide us with information when you use the Services, communicate with us, register an account, subscribe to our blog or newsletters, or participate in our community, social media discussions, or promotions. The information you provide directly may relate to yourself and others and may include:

  • Identifiers, such as name, email address, phone number, display name, or username;
  • Demographic information, such as your date of birth and general geolocation information;
  • Interests, such as categories like "Sports" or "Writing";
  • Inferences, such as preferences based on account settings or feedback on the Services;
  • Financial information, such as payment information and other information collected through our payment processing service providers;
  • Commercial information, such as purchase and transaction history;
  • Submitted content, such as chat communications, posted images or videos, biographical descriptions, and shared Characters;
  • Voice data, including your voice recordings, if you have chosen to use certain voice features; and
  • Content of communications with us, such as customer support messages.

The information you provide directly may also include information that could be treated as sensitive under applicable laws, such as login credentials, personal communications received or sent using our Services, or other personal information you choose to provide when using our Services (for example, if you voluntarily post content revealing your ethnicity, religion, or sexual orientation). Sensitive personal information is not required or necessary to use the Services: please do not include sensitive personal information in your interactions with us or the Services.

Information We Collect About Your Use of the Services

We and our third-party providers, including advertising and analytics providers and other service providers, use cookies, web beacons, and other tracking technologies to collect information about your use of the Services. Please note that specific tracking technologies and third-party providers may vary depending on your geographic location and whether you access the Services through our websites or mobile applications. For more information on these technologies, please consult our Cookie Policy.

As further described in the Cookie Policy, we use these technologies to collect and analyze information about devices, Internet, and other electronic network activity, including information about your computer or device (e.g., device type, browser type, ISP or operating system, IP address; device identifiers, such as IDFA, Android ID, etc.; version of our Services you use); information about how you use and interact with the Services (e.g., domain name; access time; referring or exit pages; page views; identifiers related to the Services, such as user ID, chat ID, session ID, etc.); and actions taken within the Services); and geolocation data.

Information We Collect From Other Sources

We may also collect information from other sources, for example, when another user refers you to us. In this context, we may receive your name and contact details. We may also receive information from third-party platforms, for example, when you interact with our ads on other platforms like YouTube, TikTok, or Reddit, or when you interact with our social media profiles on platforms like Facebook, Instagram, or Discord. The information we collect in this context includes information about how you interacted with our ads or the third-party platform, information about your device, demographic information (e.g., age, interests), and geolocation data.

We also collect information when you access your account using an account managed by third parties, such as a social media account ("Third-Party Account"). The Services collect information about you from your third-party accounts in accordance with your permissions. When you connect to us or log in via a third-party account like Facebook or Google, we receive information from those third parties that identifies your account. The information we collect in this context includes third-party account details, such as username or email address. We collect and store this information and use it to help you connect to the Services. Linking your account to a third-party account is completely optional, and you will have the opportunity to grant permission when you attempt to connect. You can revoke permission by accessing the third-party account and disconnecting Archetype from there and through native applications on your mobile device. Please note that if you revoke permission for a third-party account, we may retain information previously collected from the Third-Party Account provider (but the accounts will no longer be linked in the future).

We also collect information available on the Internet or from other publicly available sources to evaluate and improve our Services, including for model training and development.

2. How We Use The Information We Collect

We use the information for the following purposes:

  • Providing, administering, and managing the Services and our business;
  • Generating and analyzing inferences about the use of the Services, such as your preferences and interests and trends on our Services (for example, which parts of the Services are used most frequently, how users navigate the Services, and what our users like or dislike);
  • Personalizing the Services based on your preferences and interests;
  • Evaluating the success of advertising campaigns;
  • Communicating with you, including informing you about features or aspects of the Services that we believe may interest you;
  • Communicating with you regarding changes to our terms, conditions, or policies; or responding to your requests, comments, feedback, or questions;
  • Analyzing, maintaining, improving, modifying, personalizing, and measuring the Services, including training our AI/machine learning models;
  • Developing new features, algorithms, and machine learning models, programs, and services;
  • Providing advertising and recruiting new users, including providing personalized advertising;
  • Authenticating your account credentials, if necessary to access the Services and help protect the security of your account;
  • Processing payments;
  • Detecting and preventing fraud, criminal activity, or misuse of our Service and maintaining the security of our IT systems, architecture, resources, customers, and networks; and
  • Complying with legal obligations and legal proceedings and protecting our rights, privacy, safety, or property, and/or those of our affiliates, the user, or other parties, including enforcing our Terms of Service and any other agreement or policy.

We combine the information we collect through the Services with information we obtain from other sources. We may also aggregate or anonymize information collected through the Services. We use and disclose aggregated or anonymized data for a variety of purposes, including, without limitation, research and marketing purposes. To the extent we anonymize data originally based on personal information so that it is no longer reasonably linkable to an individual or household, we maintain and use such data in de-identified form and will not attempt to re-identify it (except for the purpose of confirming that it is de-identified).

3. When We Disclose The Information We Collect

We disclose information in one of the following circumstances:

  • Affiliates. We disclose information to our affiliates and subsidiaries, who may use the disclosed information consistent with this Policy.
  • Vendors and Service Providers. We disclose information to employees, consultants, service providers, and other vendors who need access to such information to perform activities or services on our behalf, such as those providing data storage, payments, technology support and services, customer support, analytics, fraud prevention, content moderation, legal services, and marketing and advertising services.
  • Safety and Protection of Archetype and Others. We may disclose certain information if we believe in good faith that it is necessary or appropriate to (i) protect or defend Archetype or other parties, including defending or enforcing this Policy, our Terms of Service, our Community Guidelines, or other policies or any other contractual agreement; and/or (ii) protect the rights, property, or personal safety of Archetype, our agents and affiliates, our employees, users, and/or the public.
  • Advertising and Analytics. We may disclose personal information to advertising and analytics service providers in connection with providing personalized advertising, to monitor the performance of advertisements displayed on our behalf on the Services and on the Internet, to provide analytics services, and to help improve our Services. These entities may use cookies and tracking technologies to enable us, among other things, to track and analyze data, determine the popularity of certain content, provide personalized advertising and content, and better understand your online activity.   • Your Content. Some of your actions may make your content available to others, including the general public. For example, if you create or share content, such as creating Characters or a "public" Voice, we may make such content available and visible to others.
  • Legal Requirements. We may disclose certain information if we believe in good faith that it is necessary or appropriate to comply with any legal, regulatory, or law enforcement requirement, for example, to respond to a warrant, subpoena, court order, or other applicable laws and regulations.
  • Business Transfers. We may disclose certain information in connection with or during negotiations or conclusion of any merger, sale of company assets, financing, or acquisition of all or part of our business to another company.
  • Other Disclosures with Your Consent or at Your Direction. We may disclose additional information to third parties when you ask us to do so. For example, when you ask us to disclose information about you when you speak about us or our Services to your friends or other acquaintances.

4. Your Choices

We offer you certain choices regarding the collection, use, and disclosure of your personal information.

  • Profile Information. You can delete your account via your account profile page. You can also verify, correct, update, or delete some of your information via your account profile page.
  • Marketing Communications. You can unsubscribe from marketing emails by following the instructions contained in such emails. Please note that if you unsubscribe from marketing emails, we may still send you administrative emails regarding the Services, including, for example, notifications of updates to our Terms of Service or this Policy.
  • Cookies. Depending on where you live and the options available on your device or browser, you may have the ability to manage cookies in use. For more information, please consult our Cookie Policy.

Rights to Information About You. For more information on region-specific rights for residents of the European Economic Area, the United Kingdom, and the United States, please refer to our Regional Privacy Policies. Depending on where you live and subject to exceptions under local law, you may have the following rights:

  • To request information about our processing of your personal data;
  • To request access to and/or a copy of certain information we hold about you (including in a portable and/or machine-readable format);
  • To object to how we process personal information;
  • To opt-out of the sale of personal information or targeted advertising;
  • To update or correct your personal information;
  • To request the deletion of certain personal information we hold about you;
  • To restrict how we process certain personal information about you;
  • To request the transfer of your information to a third-party service provider;
  • To withdraw consent to the processing of your personal data, where under applicable laws you have previously provided consent; and
  • The right not to be discriminated against for exercising your rights.

Please note that some information may be exempt from such requests under applicable law. For example, we may retain certain information to comply with laws and protect our Services. We may need certain information to provide you with the Services; if you ask us to delete it, you may no longer be able to use the Services.

If you wish to inquire about your rights or if you wish to exercise rights you may have under applicable law, please contact us at privacy@archetype.com. To protect your privacy and security, we take reasonable steps to verify your identity and requests before granting them. If we are unable to verify your identity, we may not be able to respond to your requests.

5. Regional Privacy Policies

Depending on where you live, you may have specific rights or there may be certain information we need to make available to you. If you reside in the European Economic Area, the United Kingdom, or the United States, please consult our Regional Privacy Policies for further information that may concern you.

6. Children's Privacy

The Services are not designed for children under 13, and our Terms of Service prohibit their use by anyone under 13, or under 16 if residing in the European Economic Area or the United Kingdom.

7. Data Retention

General. We retain your information for the time necessary for the purposes for which it is processed or as otherwise described at the time of information collection, unless the law requires a shorter retention period. The period of time for which we retain information depends on the purposes for which we collected and used it and your choices, after which we may delete and/or aggregate it. We may also retain and use this information if necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Popular Characters. If a Character you created has been made available to other users, we reserve the right to preserve its characteristics and keep it active in the Services, even if you delete your data and account. We do this to avoid affecting the experience of other users. To ensure that we do not retain information about you in this case, please avoid submitting such information as part of the character creation flow if you are creating a character you intend to make available to others.

8. Links to Third-Party Websites

The Services may contain links to third-party websites or services. We are not responsible for the content or practices of such websites or services. The collection, use, and disclosure of your information by third parties will be governed by the privacy policies of the third-party websites or services and not by this Policy. We urge you to read the privacy and security policies of such third parties before providing them with information.

9. Changes to this Policy

We may update this Policy from time to time. We will indicate the date of the most recent update in this Policy. In the event of a material change to the Policy, you will receive appropriate notice in accordance with legal requirements, for example via email or prominent posting on our website or mobile application. By continuing to use the Services, you confirm that you have read and understood the latest version of this Policy.
